SMS MESSAGING TERMS OF SERVICE (MOBILE TERMS

1) Who we are and what these Terms cover

The SMS messaging service (the “Service”) is operated by Board Sports Srl, registered office: Via Archimede 96, 20129 Milan (MI), Italy, VAT no. 12296840965 (“Board Sports”, “we”, “us”). By using or subscribing to the Service, you agree to these terms (“SMS Terms”).

We may modify, suspend, or discontinue the Service and/or update these SMS Terms at any time. Any changes will be effective upon publication on our website.

2) What messages you may receive

Depending on the consent you provide and your interactions with us, you may receive recurring SMS messages, including:

• Promotional messages: offers, discounts, product launches, and other marketing initiatives;
• Reminders: for example, reminders and communications related to promotional initiatives.

If “cart reminder” SMS messages are offered, they are treated as promotional communications and will be sent only if you have provided specific consent to receive marketing SMS.

3) Consent, optional nature of subscription, and legal basis (EU/Italy)

By subscribing to the Service and providing your mobile number through the relevant sign-up method (e.g., a form/landing page), you provide a free, specific, informed, and unambiguous consent to receive promotional SMS messages from Board Sports.

• Legal basis: your consent under Article 6(1)(a) GDPR and the Italian rules on marketing communications via automated systems (Article 130 of Legislative Decree 196/2003).
• Not a condition of purchase: you can buy products or services even if you do not subscribe to the Service.

You may withdraw your consent at any time (see “Unsubscribe/STOP”). Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal.

4) Costs and message frequency

We do not charge for sending SMS messages. However, your mobile carrier may apply charges according to your plan (SMS/data). Message frequency may vary.

5) Unsubscribe (OPT-OUT) and support

You can opt out at any time by replying “STOP” to any of our SMS messages. After you send STOP, you may receive a one-time confirmation message; after that, you will no longer receive promotional SMS messages unless you re-subscribe.

6) Mobile number requirements and delivery responsibility

You are responsible for providing a valid and up-to-date mobile number. If you change your number, you will need to subscribe again using your new number.

SMS delivery may be affected by technical factors (network/carrier/device) and cannot be guaranteed in all circumstances. Carriers are not liable for delayed or undelivered messages.

7) Limitation of liability

To the extent permitted by applicable law, Board Sports shall not be liable for delays or failures in SMS delivery, nor for any actions taken (or not taken) in reliance on messages sent through the Service.

8) Privacy and personal data processing

We process your mobile number and messaging preferences to manage your subscription, send messages, and handle opt-outs, including through technical service providers (e.g., messaging platforms).
